Major Milestone in AI Regulation: The EU AI Act Enters into Force!

On August 1, 2024, the European Commission announced a significant development in artificial intelligence—the entry into force of the EU Artificial Intelligence Act (EU AI Act). This landmark legislation aims to establish a harmonized internal market for AI across the EU, ensuring AI technologies are trustworthy and equipped with safeguards to protect individuals' fundamental rights.

Key Provisions of the EU AI Act:

  • Minimal Risk AI Systems: These systems have no obligations under the EU AI Act.
  • Transparency Risks (e.g., Chatbots): Obligations include disclosure to users and specific labeling requirements for AI-generated content.
  • High-Risk AI Systems: Requirements include risk-mitigation systems, high-quality datasets, detailed documentation, clear user information, and human oversight.
  • Unacceptable Risk AI Systems: These systems are strictly prohibited.

The EU AI Act also addresses general-purpose AI (GPAI) models, ensuring transparency and mitigating potential systemic risks.

Enforcement and Implementation:

  • Member States must designate national competent authorities by August 2, 2025, to oversee the application of the EU AI Act and conduct market surveillance.
  • The EU Commission's AI Office will handle implementation and enforcement at the EU level.

Key Dates to Remember:

  • February 2, 2025: Prohibitions on AI systems presenting unacceptable risks take effect.
  • August 2, 2025: Rules for GPAI models come into force.
  • August 2, 2026: Majority of the rules under the EU AI Act will apply.

The Commission has also launched the AI Pact, encouraging AI developers to adopt key obligations of the EU AI Act voluntarily. Furthermore, guidelines are being developed to detail the implementation of the Act.
