Employers in Cyprus Must Submit Employment Terms by 28 February 2025
A major compliance deadline is approaching for all employers in Cyprus. As of 20 December 2024, the Minister of Labour and Social Insurance issued Decree Κ.Δ.Π. 455/2024, requiring businesses to submit essential terms of employment for all employees through the “ERGANI” information system between 2 January 2025 and 28 February 2025.
This mandate arises from the Transparent and Predictable Working Conditions Law of 2023 (Law 25(I)/2023), which implements EU Directive 2019/1152 into Cypriot legislation. The new law aims to improve working conditions by ensuring greater transparency and predictability in employment terms.
What Employers Must Submit
The Decree outlines specific employment details that must be recorded, including:
✔ Employer’s Details – Business name, identity, and registered office.
✔ Type of Business – The nature of the enterprise (mandatory for retail businesses).
✔ Employee Details – Identity, job description, and specialization.
✔ Place of Work – The designated workplace stated in the contract and the actual work location.
✔ Employment Dates – Start date and end date (for fixed-term contracts).
✔ Probationary Period – Duration and conditions.
✔ Annual Leave – Allocation and duration.
✔ Remuneration – Salary details and frequency of payment (daily, weekly, monthly, or hourly).
✔ Working Hours – Standard or unpredictable work schedules.
✔ Additional Benefits – Commissions, allowances, cost-of-living adjustments, etc.
This information must be provided in writing (either electronically or on paper) and made accessible to employees. Employers must also maintain proof of delivery and receipt.
The Consequences of Non-Compliance
Failure to comply with the ERGANI submission requirements could result in penalties, including fines up to €5,500. Employers must act now to review their employment contracts, update policies, and ensure that all necessary data is submitted within the specified timeframe.
